Yes if: you sell to consumers — Shopify, WooCommerce or custom build alike. Pure subscription / booking flows count too.
No if: B2B-only shop without consumer access OR micro-enterprise (< 10 employees AND < €2M annual turnover/balance sheet).

§ 37 (1) BFSG
up to €100,000
Core breaches: non-compliant products or services on the market, missing or incorrect CE marking, false declaration of conformity.
§ 37 (2) BFSG
up to €10,000
Secondary duties: missing information, incomplete documentation, breach of cooperation and evidence obligations to supervisory authorities.
State market-surveillance authorities enforce. In practice, warning letters from consumer- and competition-protection associations often arrive before state fines — with their own legal and cease-and-desist costs attached.

The EAA/BFSG applies to businesses offering digital services or products to consumers. Micro-enterprises (under 10 employees AND under €2M annual turnover) are exempt for services, but not for products (hardware, software sales). Describe your situation briefly, and you get an initial assessment within 48 h.
Market surveillance authority (in Bavaria: Gewerbeaufsicht) is responsible. Fines up to €100,000 possible; in practice warnings and remediation deadlines come first. More important: abmahnungen by interest groups are realistic and already being observed.
No. Automated tools cover ~30–40 % of barriers, the rest needs manual review. Keyboard nav, screen reader flow and semantic structure require human judgement. "Accessibility overlays" are legally controversial and don't help against legal challenges.
Should be reviewed and updated annually, at the latest on larger content or structural changes. The annual monitoring package (from €800) covers this.
Happens when the existing site runs on outdated framework or heavy technical debt. In that case we show in the audit recommendation that rebuild is more economical than remediation, and offset audit costs against a new Business or Custom project.
